VolumeDrive.com Accuses Me of Stalking and Fraud
This morning I received a certified letter from my friendly USPS Carrier.
It seems volumedrive.com feels threatened by the fact that I have taken steps to recover losses I have incurred since they deleted my data.
In part the letter reads as follows:
On Monday, December 14th, 2009, you were informed by FORMAL NOTICE, to CEASE and DESIST all communication(s) with our company and representatives. You have continually not followed this advice, but have instead increased your malice and vendetta aginst our company and it’s represnatives, in the following ways:
- Making threats via the internet aginst our company and it’s representatives.
- Making demands via the internet, to speak in person with our legal representatives, following notification to end all communication.
- Making false accusations against our company, it’s business practices and its representatives’ activities, while attempting to daming the reputations(s) of such and turn other’s against us.
- Encouraging others to harass our company and it’s representatives.
- Sending false and fraudulent invoices with no legitimate purpose, both via the internet and U.S. Mail Service; in an attempt to extort in the amount of ($10,000).
- Threatening to come to our place of business in person, “accompanied by friends”.
- Threatening to bring a Class Action Lawsuit against our company, with the assistance of your friend and clients that you have previously referred to us for business purposes.
The letter goes on to reference Wikipedia as a valid source for information about Stalking, which I find extremely funny. Then goes on to point out two Pennsylvania statues about Harassment and reporting of fraud to the authorities.
First off, I don’t know any of such “FORMAL NOTICE” to stop communicating with them as this certified letter is the first even semi-official communication I have had with VolumeDrive.com. I did receive an email from “Josh B.” saying he was referring all future communication to their legal representatives, but then refused to provide any sort of contact information.
I am not going to bother to respond to most of these accusations, as I do intend to utilize every legal avenue in recovering the unnecessary costs and loss of business that I have incurred by the actions of VolumeDrive.com.
I will state that I was never provided with an invoice nor so much as a demand for payment prior to the deletion of data.
Why didn’t a representative of VolumeDrive.com make a simple phone call or even send a personal email, in an attempt to make direct contact, prior to deleting customer owned data? Especially by their own admission, in their certified letter, bullet point number 7, they absolutely knew I referred MULTIPLE customers to their business.
Also, why did this action take place in the early hours of a Saturday morning, when by VolumeDrives’ own admission no ‘Billing Person’ was available on the weekends? They also stated that I would have to wait until Monday to resolve the so-called ‘billing issue’.
I would like also like to point out that VolumeDrive.com has repeatedly refused to provide FULL contact information for a ‘responsible party’ or legal representative. All communication I have received has been with either a “Josh B.” or various other initialed ‘last names’.
Even their certified letter did not provide FULL contact information of who sent it – just initials.
Finally, the only Snail Mail address I have found for VolumeDrive.com is a MailBox Etc / UPS Store location, thus how could I show up to their place of business, “accompanied by friends”? — even for a moment if that accusation was true.
History shows that I am not against using Personal Mailboxes for a business address, but I have never ONCE attempted to hide my identify or the ability to contact myself or other appropriate business representative directly when a customer has had a problem with one of my businesses.
Obviously Volumedrive.com has something to hide.
Caveat Emptor
